1. Important information and who we are

Purpose of this Policy

This Policy sets out how Continuum collects and processes your personal data.

This website is not intended for children and we do not knowingly collect data relating to children.

It is important that you read this Policy together with any other privacy policy or fair processing policy or notice we may provide on specific occasions when we are collecting or processing personal data about you, so that you are fully aware of how and why we are using your data. This Policy supplements other such notices and privacy policies and is not intended to override them.

  • Right to work data may include copies of documents which prove you have the right to work in the UK, including your passport, passport card, driving licence, utility bills and your share code (if you have a biometric residence card or permit or a frontier worker permit) and/or information obtained from the Home Office (if relevant, for example if the Home Office are contacted in order to receive a "Positive Verification Notice" to prove you have the right to work in the UK).
  • Criminal offence data including details of any unspent criminal convictions.
  • Career data may include information about your place(s) of work, job title(s), employment history, qualifications and/or information contained in your CV and cover letter or email, references (and information obtained from your referees) and other information provided and/or made available to us during the recruitment process, including details of your salary, bonuses and other emoluments, together with details of your performance record.
  • Marketing and communications data such as your marketing and communication preferences in respect of us and (where relevant) third parties associated and/or affiliated with us.

We will not usually collect any special categories of personal data about you (e.g. personal data relating to racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data, data concerning health or data concerning sex life or sexual orientation), although we do process criminal offence data in certain circumstances as noted above.

We may also collect, use and share "Aggregated Data" such as statistical or demographic data for any purpose. This Aggregated Data could be derived from your personal data but is not considered personal data under data protection laws as this data will not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this Policy.

If you fail to provide personal data

This is a Google analytics cookie and is used to distinguish unique users by assigning a randomly generated number as a client identifier. It is included in each page request in a site and used to calculate visitor, session and campaign data for the sites analytics reports.

This is a Google analytics cookie, used to throttle the request rate - limiting the collection of data on high traffic sites. It expires after 10 minutes.

This is a Google session cookie, used to distinguish users. Default expiration time: 24 hours.

exp_csrf_token

This cookie protects against Cross Site Request Forgery (CSRF). A CSRF attack forces a logged-on victim’s browser to send a forged HTTP request, including the victim’s session cookie and any other automatically included authentication information, to a vulnerable web application. This allows the attacker to force the victim’s browser to generate requests the vulnerable application thinks are legitimate requests from the victim.

exp_tracker

This cookie tracks the last 5 pages viewed by the user, and is used primarily for redirection after logging in etc. Used for both guests and logged in users.

exp_last_activity

Every time the site is updated (the page reloaded) the last activity is set to the current datetime. This cookie is used to determine expiry. This is essential for logged in users, but not for guests - it is set for both.

exp_last_visit

This cookie sets the datetime that the user last visited the site, and is set for both guests and logged in users. If not set, the datetime is automatically set to 10 years ago. Used for guests and logged in users.

Sets a cookie to prevent the cookie consent warning appearing on each page once you have selected your preference.

Marketing

We may send marketing communications to you, by email or text, if you have consented or opted-in to receiving these (including by subscribing to receive communications from us via our website) or have previously purchased services from us and you have not opted out of, or unsubscribed from, receiving such marketing. We may use third party service providers to store and manage personal data which is collected by us for marketing purposes. Our current service provider for this purpose is Campaign Monitor.

Opting out/Unsubscribing

You can require us to stop sending you marketing messages at any time by following the opt-out/unsubscribe links on any marketing message sent to you or by emailing us at enquiries@continuum.partners or by contacting us in writing at Continuum at FAO: Karen Harte, Becket House, 36 Old Jewry,London EC2R 8DD.

Change of purpose

We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish for an explanation of how the processing for the new purpose is compatible with the original purpose, please contact us using the email address above.

If we need to use your personal data for an unrelated purpose, we will notify you of this and, where required, obtain consent to do so.


6. Disclosures of your personal data


We may share your personal data with our affiliates or third parties, such as other advisors (including lawyers and accountants), service providers, providers of third party software, providers of document storage services, IT service providers, regulatory bodies (such as the FCA and HMRC), background, compliance, anti-money laundering and credit check agencies, and other parties involved in your matters, for the purposes set out in the tables above. We may also use third party service providers to store and manage personal data which is collected by us for marketing purposes. Where such data is provided to third parties, except if the third party acts as "controller" (such as a law firm or other corporate advisory firm) and is therefore bound to comply with data protection laws anyway, we will enter into agreements with such third parties to ensure that they process that data in accordance with the requirements of the data protection laws.

Please note that we may also share your personal data with third parties in the context of a business re-organisation, sale or acquisition.

7. International transfers

Certain of our advisers, suppliers and other service providers are based outside the UK so their processing of your personal data will involve a transfer of data outside the UK.

Whenever we transfer your personal data out of the UK, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following circumstances applies:

  • The country where the recipient is located has been deemed by the UK Secretary of State to provide an adequate level of protection for personal data.
  • Appropriate safeguards are in place (such as specific contracts approved by the UK Parliament).

8. Data security

We have put in place what we consider to be appropriate security measures designed to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a legitimate business need-to-know.

We have put in place procedures designed to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

9. Data retention

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

In some circumstances you can ask us to delete your data: see section 10. Your legal rights below for further information.

In some circumstances we will anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

10. Your legal rights

In certain circumstances, you have the following rights under data protection laws in relation to your personal data:

Request access to your personal data: This enables you to receive a copy of the personal information we hold about you and to check that we are lawfully processing it.

Request correction of your personal data: This enables you to have any incomplete or inaccurate information we hold about you corrected.

Request erasure of your personal data: This enables you to ask us to delete or remove personal information where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal information where you have exercised your right to object to processing (see below).

Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground. You also have the right to object where we are processing your personal information for direct marketing purposes.

Request restriction of processing your personal data: This enables you to ask us to suspend the processing of personal information about you, for example if you want us to establish its accuracy or the reason for processing it.

Request transfer of your personal data to another party.

Right to withdraw consent: If we are processing your personal data on the basis of your consent, you have the right to withdraw such consent at any time. Withdrawing your consent will not affect the lawfulness of processing based on consent before its withdrawal. To withdraw your consent or to opt out of, or unsubscribe from, receiving marketing communications, please email enquiries@continuum.partners or write to Continuum at FAO: Karen Harte, Becket House, 36 Old Jewry, London EC2R 8DD or follow the unsubscribe instructions included in each electronic marketing communication. Once we have received notification that you have withdrawn your consent, we will no longer process your information for the purpose or purposes you originally agreed to, unless we have another legitimate basis for doing so in law.

No fee usually required

You will not usually have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.

What we may need from you

We may need to request specific information from you to help us confirm your identity and your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

Time limit to respond

We try to respond to all legitimate requests within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

11. Glossary


LAWFUL BASIS

Legitimate Interest means the interest of our business in conducting and managing our business to enable us to give you the best service/product and the best and most secure experience. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your personal data for our legitimate interests. We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law). You can obtain further information about how we assess our legitimate interests against any potential impact on you in respect of specific activities by contacting us.

Performance of Contract means processing your data where it is necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract.

Comply with a legal obligation means processing your personal data where it is necessary for compliance with a legal obligation to which we are subject.

THIRD PARTIES

External Third Parties

  • Other individuals and entities affiliated with Continuum, in the UK and overseas.
  • Service providers based in the UK and EEA who provide IT and system administration services.
  • Professional advisers including lawyers, bankers, auditors and insurers based in the UK, US and EEA who provide consultancy, banking, legal, insurance and accounting services.
  • HM Revenue & Customs, regulators and other authorities based in the UK and EEA who require reporting of processing activities in certain circumstances.

YOUR LEGAL RIGHTS

You have the right to:

Request access to your personal data (commonly known as a "data subject access request"). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.

Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.

Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.

Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios:

  • If you want us to establish the data's accuracy.
  • Where our use of the data is unlawful but you do not want us to erase it.
  • Where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims.
  • You have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.

Request the transfer of your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.

Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.
